1. Purpose and Scope

Four Seasons Heating, Air Conditioning, Plumbing, Sewer & Electric (“Four Seasons,” “we,” “us,” or “our”) is committed to protecting online user and customer privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information from third parties or when Users (a) visit or use our websites at (the “Site” or “Sites”), (b) communicate with us by telephone, email, text message (SMS/MMS), or other electronic means, (c) request or receive our products or services, whether in person or through a service proposal, work order, or invoice, (d) interact with us through third-party platforms, social media, or online advertising, (e) are identified through third-party data sources, marketing lists, or lookalike/targeting services used to reach prospective customers who have not previously interacted with us or (f) otherwise  provide information to us in connection with our business (collectively, the “Services”).

This policy applies to customers, prospective customers, website visitors, users who submit questions, comments, reviews, forms, contest or promotional entries, and persons who interact with the Site or provide customer information to Four Seasons. For purposes of this policy, these individuals may be referred to as “Users,” “prospects”, “customers,” or “Site Users.”

2. User Consent to Privacy Policy

Any person accessing, browsing, or otherwise using the Site, either manually or through an automated device or program, is considered a “User” and is bound by this Privacy Policy. By using the Site or providing information to Four Seasons, Users consent to the collection, use, retention, and disclosure of personally identifiable information (“Information” or “Personal Information”) as described in this policy.

3. Customer Information Collected

Four Seasons may collect or use information that a User or customer voluntarily provides, information automatically collected or obtained through website and technical activity, or information provided by third parties. This may include:

• Contact and Identity Information: Name, mailing address, billing address, shipping address, email address, telephone number(s) (including mobile phone numbers), and other contact details provided when requesting a service estimate, placing an order, entering into a service agreement, submitting a customer review, contacting us with a question or comment, or registering for a promotional feature or contest;
• Communications Information: Records of communications with us, including telephone call recordings (where permitted by law and disclosed at the time of the call), emails, text messages, chat transcripts, customer reviews, survey responses, questions, comments, and website form submissions;
• Financial and Transaction Information: Credit card numbers, debit card numbers, expiration dates, billing information, payment history, purchase, order, appointment, scheduling, service, warranty, membership, promotional, or account-related information collected in connection with purchases of products or services;
• Service and Property Information: Information about a customer’s property, equipment, and service history that is relevant to the products and services we provide, including descriptions of work performed, equipment installed, and photographs or videos of job sites taken by our technicians in the course of providing services;
• Device and Usage Information: Through the use of cookies and similar tracking technologies (described below), we may automatically collect information when Users visit the Site, including IP address, browser type and version, operating system, device type, unique device identifiers, pages visited, referring and exit URLs, date and time of access, clickstream data, and general website activity;
• Cookies and Tracking Technologies: Information collected through cookies, web beacons (pixel tags), local storage, and similar technologies as described below.
• SMS Opt-In and Phone Numbers for Third-Party Marketing: We do not share, sell, or otherwise disclose mobile phone numbers or SMS message consent data with third parties or affiliates for such third parties or affiliates to use for their own marketing or promotional purposes.

4. How We Disclose Personal Information

We may disclose your Personal Information for any purposes not inconsistent with this Privacy Policy, our written statements at the point of collection, or applicable law. In general, we disclose Personal Information as follows:

• Across our corporate family, meaning affiliated companies, subsidiaries, locations, and brands under common ownership.
• With vendors, marketing partners, and service providers who perform work on our behalf, such as customer support, business operations, product and service improvements, marketing promotions and rewards programs, payment processing, credit assessments related to card transactions, audits and quality assurance, and general business communications. SMS messaging consent is never included in this sharing.
• With advertising and analytics vendors, including data analytics providers and advertising firms, to support ad targeting, remarketing, and personalized advertising aimed at improving our communications with you. SMS messaging consent is never included in this sharing.
• For legal and compliance reasons, including to comply with laws, regulations, subpoenas, or court orders; to respond to government or regulatory inquiries, including licensing bodies and permitting authorities; to support annual financial audits; to meet financing-related obligations; to investigate or pursue claims against anyone who may be harming us or others; to defend or assert legal claims in any proceeding; to enforce our agreements; to protect our rights, safety, property, or operations, or those of others; to support internal investigations or disciplinary matters; and to pursue available remedies.
• With insurers and legal or professional advisors, to manage risk, obtain guidance, and support or defend legal claims.
• In connection with business transactions, such as a merger, acquisition, reorganization, financing, joint venture, or sale of assets or stock, including in bankruptcy or similar proceedings.

5. Cookies, Website Analytics, and Technical Information

The Sites may use cookies, which are files placed by a User’s web browser on the User’s computer or device, to assign an identification code and collect browsing information. Cookies and similar technologies may support website functionality, improve the user experience, analyze activity, and support marketing efforts.

Four Seasons may work with third-party service providers that use cookies, pixel tags, and similar technologies to collect information about User activity on the Site and other websites in order to provide analytics, measure advertising effectiveness, and deliver targeted advertisements. These third parties may combine information collected on our Site with information collected from other sources.

Users may configure their browser to provide notice when cookies are received or to prevent cookies from being sent. If cookies are disabled, certain Site functionality may be limited, especially when submitting information, using interactive features, or completing transactions through the Site.

6. SMS and Email Marketing

All persons receiving marketing SMS text messages from Four Seasons Heating, Air Conditioning, Plumbing, Sewer & Electric have provided express written consent to receive such messages, obtained through a written or electronic agreement that clearly authorizes Four Seasons to send marketing messages to the mobile number provided. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of any purchase. Four Seasons will not sell, rent, or share User mobile phone numbers with third parties for their independent marketing purposes. Four Seasons’ obligation to honor opt-out requests shall survive completion of the Services.

All persons receiving email marketing messages from Four Seasons Heating, Air Conditioning, Plumbing, Sewer & Electric may unsubscribe at any time using the unsubscribe link included at the bottom of marketing emails.

We may also send transactional text messages and emails related to appointment scheduling, invoice and payment notifications, and service updates regarding a customer’s current or scheduled work order. These transactional messages are not marketing and do not require the same express written consent, though customers may request to opt out of these messages.

7. Use of Information

Four Seasons may use collected information for business, operational, customer service, transaction, website, and marketing purposes, including to:

• Respond to customer or User questions, comments, inquiries, reviews, and service requests;
• Administer a User’s contest entry or participation in promotional features;
• Fulfill purchase, order, appointment, scheduling, service, billing, warranty, or account requests and provide status updates;
• Provide Users with important Site functionality changes, company services, business updates, and special offers that may be valuable;
• Deliver marketing and advertising communications, including email, SMS, and direct mail, where permitted;
• Improve, optimize, and analyze website functionality, customer experience, marketing performance, and business operations;
• Support security, fraud prevention, legal compliance, recordkeeping, reporting, and operational needs.

8. Disclosure to Service Providers, Sub-Processors, and Third Parties

Four Seasons may disclose customer or User information to trusted service providers, vendors, sub-processors, contractors, platforms, and other third parties that assist Four Seasons in operating the business, providing services, supporting the Site, processing transactions, communicating with customers, performing analytics, delivering marketing or advertising communications, sending direct mail, and supporting other legitimate business operations.

These service providers and sub-processors are authorized to use customer or User information only as necessary to provide services on behalf of Four Seasons, unless otherwise required by law, authorized by the customer, or approved by Four Seasons for a legitimate business purpose.

Examples of service providers or sub-processors may include website hosting and analytics providers, customer relationship management systems, scheduling and dispatch platforms, call centers or communication providers, email and SMS platforms, payment processors, financing partners, direct mail providers, marketing and advertising providers, cloud platforms, and other business systems used to support customer service and company operations.

9. No Sale or Unrelated Disclosure of Customer Information

Four Seasons does not sell customer personal information in the traditional sense. Four Seasons does not disclose customer personal information to unaffiliated third parties for their own independent marketing purposes.

Four Seasons may share customer information with trusted service providers, sub-processors, vendors, and business partners as described in this policy when such sharing is necessary to provide services, operate the business, process transactions, communicate with customers, deliver marketing or advertising on Four Seasons’ behalf, comply with legal obligations, protect rights or safety, or support a sale or acquisition as described below.

Customer information will be disclosed only for legitimate business purposes and only to authorized recipients, service providers, or third parties consistent with this policy and applicable company requirements.

10. Data Retention

We retain Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide our products and services, maintain User accounts, comply with our legal and regulatory obligations, resolve disputes, enforce our agreements, and for legitimate business purposes such as marketing, reporting, and operational analysis, as permitted by law. When Information is no longer needed for these purposes, we will securely delete or anonymize it in accordance with our data retention practices.

11. User Rights and Choices

Depending on jurisdiction, Users may have certain rights with respect to their Personal Information, including:

• Right to Access: Users may request that we confirm whether we are processing their Personal Information and provide them with a copy of the Personal Information we hold about them.

• Do Not Track: Some web browsers transmit “Do Not Track” signals to websites. Because there is no universally accepted standard for how to respond to such signals, the Site does not currently respond to “Do Not Track” signals. However, Users may manage their cookie preferences as described above.

We will respond to verifiable requests within a reasonable timeframe and in accordance with applicable law. We will not discriminate against Users for exercising any of their privacy rights.

The Site may contain links to third-party websites, applications, or services not controlled by Four Seasons. These third-party websites may collect, use, retain, or disclose information differently than Four Seasons. Four Seasons is not responsible for the privacy practices, content, or security of any third-party websites, and this Privacy Policy does not apply to information collected by third parties. We encourage Users to review the privacy policies of any third-party websites they visit. Four Seasons expressly disclaims any and all liability related to such third-party practices.

13. 13. Children

The Four Seasons Site and products and services are not directed toward children under 18 years of age, and Four Seasons does not knowingly collect information from children under 18 years of age.

14. 14. Security

Four Seasons maintains commercially reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of Information under our control. These measures include, but are not limited to, encryption of sensitive data during transmission (such as credit card information) using Secure Socket Layer (SSL) technology or equivalent protocols, access controls, firewalls, and secure data storage. We regularly review and update our security practices to address emerging threats.

No method of transmission over the Internet, and no method of electronic storage, is completely secure. While we strive to use commercially reasonable means to protect User Information, we cannot guarantee its absolute security. Four Seasons shall not be responsible for any actual or consequential damages that result from unauthorized access to Information due to a security breach or technical malfunction, except to the extent required by applicable law.

15. 15. Sale or Acquisition

In the event that another company acquires Four Seasons Heating, Air Conditioning, Plumbing, Sewer & Electric or all or part of its assets, Four Seasons reserves the right to include customer and User information among the assets transferred to the acquiring company.

16. 16. Applicable Law and International Users

Information submitted to the Site or provided in connection with the Services will be collected, processed, stored, disclosed, and disposed of in accordance with applicable U.S. law. Non-U.S. Users acknowledge and agree that Four Seasons may collect and use information outside the User’s resident jurisdiction, and that such information may be stored on servers located outside the User’s resident jurisdiction.

U.S. law may not provide the same degree of protection for information that is available in other countries. By providing information to Four Seasons, a User acknowledges that the User has read this policy, understands it, agrees to its terms, and consents to the transfer of information outside the User’s resident jurisdiction. Users who do not consent to the terms of this policy should not use the Site. Users who have already provided information may contact Four Seasons for guidance on how they would like the information handled.

17. 17. Policy Amendments and Review

Four Seasons reserves the right to amend this policy periodically. This policy may be revised, modified, or updated to reflect changes in business operations, website functionality, customer communications, marketing practices, vendor or service provider relationships, legal or regulatory requirements, security needs, or company standards.

Customers and Users are responsible for reviewing the current Privacy Policy as posted or made available by Four Seasons. Continued use of the Site or continued provision of information after policy updates constitutes acceptance of the updated policy to the extent permitted by law.
